“TUZONGO” means TUZONGO Web Design and/or any affiliate which shall supply Services to you.
“TOP” means Terms of Payments (this document) and everything it contains.
“Services” collectively means what we provide to you and the purchasing of our services.
“Products” collectively means what we provide to you and the purchasing of our products.
“We,” “us” or “our” means TUZONGO Web Design.
“You” and “your” mean the person, firm or company who purchases services from TUZONGO Web Design.
“Web Design” and “website” means every aspect of the website (coding, design, modifications, templates, content, pictures, images, text, functionality, illustrations) designed or handled by TUZONGO Web Design.
“Graphic Design” means every aspect of the graphic design (concepts, illustrations, templates, samples, images, pictures and text) designed or handled by TUZONGO Web Design.
1.1 All payments must be made within 30 days of invoice unless an individual payment plan has been agreed. If a payment is not made within 30 days, TUZONGO reserves the right to remove or edit any form of the product or service provided to you that the payment relates to. If the product or service is duplicated and / or reused or produced, this act will be deemed theft.
1.2 Any and all products and services unpaid for belong to TUZONGO and we reserve the right to use, disclose, display, create derivative works from, distribute, transmit, prevent usage of, retract, destroy and reproduce any item relating to the product or service.
1.3 ‘Special Offers’ and/or Discounts have specific Terms of Service which may not apply to other work undertaken by TUZONGO.
2.1 We may charge a 30% deposit before any work is started on larger projects. This is a non-refundable charge.
2.2 The 30% deposit can be reimbursed under special circumstances agreed by a representative of TUZONGO.
3.1 Refunds are not applicable at any time before, during or after the Web Design Process or Graphic Design Process unless a special circumstance occurs that permits a representative of TUZONGO to do so.
3.2 Without limiting section 3.1, one such fixed ‘special circumstance’ is the order of a product or service before it becomes available or can be provided to you.
4. Payment Cancellation and Changes
4.1 We reserve the right to terminate a particular order or aspect of any product or service at any time during the development or design process if we believe the transaction violates these Terms of Payment or we believe doing so may prevent our financial loss.
4.2 You reserve the right to terminate a particular order or aspect of any product or service at any time during the development or design process; however, we reserve the right to charge a fee which is dependent on the work already undertaken.
4.3 Prices of products or services provided by us are subject to change at any time during or before the design and development process of any Web Design or Graphic Design with the inclusion of additional tasks, products, services, designs or development.
4.4 We may place a delay on a payment for a period of time, limit payment sources for a transaction, and/or limit your ability to make a payment if we believe doing so may prevent our financial loss.
4.5 We may contact your payment source issuer, law enforcement, or impacted third parties and share details of any payments you are associated with if we believe doing so may prevent our financial loss or a violation of law.
4.6 If you believe there is an error in an invoice you must contact us immediately so that we can each agree to work together in good faith to resolve any dispute. You should provide sufficient information for us to investigate the claim(s) which must be received by us one week prior to the Due Date for payment.
5. Payment Types
5.1 When you confirm a transaction with TUZONGO whether it be via an online, cheque or cash payment, you agree to be bound by and pay for that transaction.
5.2 In the event that a payment is made to the incorrect party, we can each agree to work together in good faith to resolve the. The party who is responsible is liable to ensure the transaction is subsequently completed satisfactorily.

126.96.36.199 All payments received online via third parties are subject to these Terms of Payment and also to the Terms of Payments present on the third party’s website.
188.8.131.52 The responsibility held for the secure transfer of funds over the internet is that of the third party and TUZONGO takes no liability for it.
5.3.2 Cheque or CIH (cash-in-hand)
184.108.40.206 Payments received via Cheque or CIH are only applicable if received from a representative of TUZONGO who has previously agreed to receive the payment.
5.3.3 Bank Transfer
220.127.116.11 All payments made via bank transfer are unpaid until the transaction is complete and appears in a bank statement. TUZONGO reserves the right to cease work or initiate any appropriate action until payment it is made in full.
6. Terms of Payment Amendments
6.1 We may make changes to the Terms of Payment at any time. Changes made to the Terms of Service will be made available at http://www.tuzongo.com/web/payments/
7.1 If you are under the age of 18, you may make payments only with the involvement of a parent or guardian. You should review these Payments Terms with a parent or guardian to make sure that you both understand them.
7.2 In the event of any conflict in relation to payments between these Terms of Payments and the Terms of Service, the Terms of Payments shall prevail.
